Summary of the House Committee Version of the Bill

SCS SB 827 -- CLASS ACTION APPEALS

SPONSOR:  Bartle (Byrd)

COMMITTEE ACTION:  Voted "do pass" by the Committee on Judiciary
by a vote of 16 to 0.

This substitute allows appeals on orders granting or denying
class action certification if the court of appeals, in its
discretion, allows the appeal and it will not delay proceedings
unless ordered by the trial court or the court of appeals.

FISCAL NOTE:  No impact on state funds in FY 2005, FY 2006, and
FY 2007.

PROPONENTS:  Supporters say that the bill makes Missouri's law on
class action cases consistent with federal law.

Testifying for the bill was Senator Bartle.

OPPONENTS:  There was no opposition voiced to the committee.
